This Event: First National Convention 2026, Vietnam
The following terms and conditions apply to Your registration for, admission to, and continued attendance at this Event, and to any of Your accompanying guests:
1. 212F Pty Ltd enters into this contract as agent for the Host: These terms and conditions form an agreement between You and 212F Pty Ltd (ABN 70 106 450 631) (“We”, “Us”, “Our”) as agent for and on behalf of First National (“Host”). All of Our obligations, rights and remedies under this agreement are obligations, rights and remedies of the Host. To the extent that this agreement confers a benefit, right or remedy on the Host, it is intended that We shall also have the benefit of it and the right to exercise
or enforce it.
2. Your capacity: You enter into this agreement in Your own personal capacity, and also for and on behalf of:
(a) any business or organisation which You represent or which employs You; and
(b) any guest other person(s) for whom You complete registration for the Event, (each of which is a "Relevant Person") and You warrant that You:
(c) have the express authority of all Relevant Persons to enter into this agreement on its/their behalf;
(d) have provided a copy of this agreement to all Relevant Persons; and
(e) have the consent of each Relevant Person (being an individual) to provide his/her personal information to Us and the Host.
3. Compliance with venue terms and conditions: You must at all times comply with the terms and conditions of entry to each venue connected with this Event, and with any lawful directions given by its authorised personnel.
4. Your cancellation of Your registration: You may cancel Your conference registration, by notifying Us by email. If You do not received acknowledgement by email within two business days, please contact 212F Pty Ltd on 03 8563 8420. Your entitlement to a refund or partial refund (if any) may depend on the reasons for, and timing of, Your notice of cancellation, as set out in the Event Website.
5. Cancellation, postponement and conversion of the Event to a partly or fully virtual Event by Host: The Host (and We, as the agent of the Host) may cancel or postpone the Event, or convert it to an on-line/virtual Event at any time, for any reason. We will notify You by email if any of the foregoing occurs and Your rights to attend (or decline to attend) the Event, if postponed and Your rights (if any) to a refund or partial refund are set out in the Event Website.
6. Your travel and accommodation expenses: Expenses for and arrangements You may make for travel and accommodation are at Your sole risk and any rights You may have to a refund or partial refund (if any, as set out in the Event Website) are Your sole entitlements on cancellation, postponement and conversion of the Event. We recommend that You consider making accommodation and transport arrangements that permit variation or cancellation with appropriate refunds. We further recommend that You obtain insurance (if available) that will reimburse You accommodation and transport costs in the event of cancellation.
7. Event subject to change – While the Host will make reasonable endeavours to stage the Event as advertised, You agree that, subject only to clause 6, the following may occur without liability of any kind to You:
(a) changes to the Event dates, the venue or the location of the Event or components of the Event within the venue;
(b) changes to programme content, its order or session times;
(c) changes to the speakers, entertainers and other presenters;
(d) changes to the social programme and the venue(s) for dinners and other social events. If any changes occur to the Event as advertised, reasonable endeavours will be made to arrange for reasonable substitutes, subject to availability and the circumstances that made the change(s) necessary or desirable. Notice of substantial and material changes will be placed on the Event Website. You are responsible for checking for such notifications/alerts prior to the Event.
8. Your conduct at this Event – At all times during this Event You must:
(a) conduct Yourself in a reasonable, respectful, considerate and lawful manner;
(b) not act, speak or otherwise communicate in a manner that is offensive, obscene or that reasonable persons may consider to be offensive or obscene;
(c) if You consume alcohol, do so reasonably and responsibly;
(d) not place the safety and health of any person(s) at the Event at risk;
(e) not cause personal injury to, or defame, any person or damage the property of any person;
(f) be respectful towards speakers and others expressing their opinions and refrain from causing a nuisance or interrupting or disrupting programme content;
(g) comply promptly with Our reasonable and lawful directions and those of the authorised staff of the Host, its contractor and of the relevant venues;
(h) Comply with all applicable health and safety regulations as set out by relevant government authorities; and
(i) ensure that each Relevant Person complies with the foregoing. We or the Host may, without liability to You or any Relevant Person, eject You (and/or a Relevant Person) from the Event and/or refuse entry to the Event or any part of the Event if We or the Host, acting reasonably, consider that You or a Relevant Person are/is in breach of these terms and conditions, or for any other reasonable cause.
9. Release of liability – You release Us and the Host from liability for any losses, costs (including legal costs and disbursements) damage or claims, including but not limited to:
(a) death or personal injury of any kind sustained by You or any Relevant Person, including but not limited to illness, infection, or any related health condition; or;
(b) damage to, loss of or destruction of Your and any Relevant Person's property or business of any kind;
(c) damage to Your reputation or that of any Relevant Person, except to the extent that such loss, cost, damage or claim is directly caused by Our negligence or that of the Host (but in which case, clause 11 applies).
10. Limitation and exclusion of liability – To the extent permitted by law: (a) to the extent permissible under the law, any claim that You and/or a Relevant Person may have in respect of goods or services supplied in connection with the Event, which claim is pursuant to a statutory right that cannot be excluded, Our liability and that of the Host is limited, in the case of:
(i) goods, to the replacement of the goods or the cost of having the goods replaced or repaired; and
(ii) services, to the resupply of the services or the cost of having the services resupplied; and
(b) Our liability and that of the Host to You and any Relevant Person for any other cause of action, including but not limited to breach of contract, negligence or other breach of duty:
(i) for travel and accommodation expenses, loss of enjoyment, loss of profit, loss or revenue, lost cost savings, loss of opportunity, loss of enjoyment or indirect or consequential loss of any kind, is excluded in full; and
(ii) for any other loss, including but not limited to personal injury or death (including from any infection, illness, or related health condition)
(iii) damage to property or any business, is limited in aggregate to the sum of the monies actually paid by You in connection with Your registration for the Event.
11. Independent contractor suppliers – You acknowledge and agree that:
(a) all goods and services supplied to You in connection with the Event (including but not limited to transport, accommodation, the venue, food and beverage, audio-visual services, security, cleaning, programme content and entertainment) will be supplied by suppliers (each, a “Supplier”) who are all independent contractors of Us and/or the Host;
(b) no Supplier, attendee, speaker, exhibitor, or sponsor is an employee, agent or partner of Us or the Host and neither We nor the Host are vicariously or jointly liable for their actions or omissions; and
(c) the views expressed by any event attendee, speaker, exhibitor, or sponsor are not necessarily those of Us or the Host. All attendees, speakers, exhibitors, and sponsors are solely responsible for the content of their presentations, marketing collateral, advertising and their actions and omissions.
12. Indemnity – (a) You must indemnify and keep Us and the Host indemnified against all losses, costs and expenses (including actual legal costs and disbursements on a full indemnity basis) incurred in connection with any claim, demand, action or proceedings arising wholly or partly, directly or indirectly, from Your act or omission, and whether such claim, demand, action or proceeding is founded wholly or partly on:
(i) Your unlawful act or omission, negligence or other tort, breach of contract (including this agreement), or other breach of duty or any cause of action whatsoever; and/or
(ii) any term of a contract by which We or the Host is made liable for Your act or omission, or otherwise. You acknowledge and agree that Your actions and omissions may make Us or the Host liable to third parties, including under indemnities.
(b) The indemnity in this clause applies except to the extent that such claim, loss, cost, or expense is directly caused by Our negligence or that of the Host, but in which case, clause 11 applies.
(c) You acknowledge and agree that the indemnity in this clause is not Our or the Host's exclusive remedy.
13. Your breach may cause Us/Host to have liability to third parties - You acknowledge and agree that:
(a) Your negligence or breach of this Agreement or of the venue’s terms and conditions of entry may cause Us to be in breach of contractual obligations (including indemnities) or other duties or obligations that We or the Host may have to the venue operator or other third parties, such as other attendees, exhibitors at, or sponsors of, the Event; and
(b) any loss or liability We incur to the venue operator or any other third party, as a direct or indirect consequence of Your act or omission, whether or not We or the Host have assumed such liability contractually, is a reasonably foreseeable loss recoverable by Us from You.
14. Photography and videography/filming –
(a) You may use handheld cameras and/or smart phones at the Event to take photographs and videos/films for personal, non-commercial use, provided the act of so doing is not disruptive, intrusive or in breach of intellectual property or privacy rights and provided that the subject of such photography and videography/filming provides consent. Such photographs and videos/films may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever.
(b) We or the Host may hire service providers (photo/video/streaming/audio) to document and display the Event experience. We and the Host may also use social media to post photos and videos and to display select submissions at the venue and on Our or the Host’s websites.
(c) You irrevocably authorise Us and the Host to:
(i) record You (picture and voice) on photos, films and sound recordings (each, a “Recording”); and
(ii) edit and incorporate the Recording into a photo, video gallery, short film or webinar as a record of and for the promotion of the Event and future similar events, or for Our or the Host's promotional purposes,
for no monetary or other compensation to You and You acknowledge and agree that You have no right, title or interest in such Recording.
15. Relevant Persons – If You register a Relevant Person (or for and on behalf of a Relevant Person - see the definition in clause 2) for this Event, You must ensure that each Relevant Person complies with these terms and conditions of registration and attendance. If You are a guest of a registrant for the Event or other Relevant Persons, it is a condition of Your admission to and continued attendance at the Event, that You agree to these terms and conditions of registration and attendance and that You comply with them. If You do not agree to these terms and conditions of registration and attendance, please notify Us and Your name will be removed from the guest list.
16. Privacy and electronic messages – You consent to:
(a) Our collection, use and disclosure of Your personal information, including sensitive information as defined in the Privacy Act 1998 (Cth).
(b) You consent to Our disclosure of Your personal information, including "sensitive" personal information to the Host,
and to Suppliers, to the extent We consider it necessary or desirable to enable them to provide appropriate goods or services to You;
(c) sending You electronic messages concerning the Event and any other event that We reasonably consider You may be interested to attend.
(d) sharing of your name, company and contact details to paying sponsors at Our or the Host's discretion.
17. Assignment (transfer) of Your registration – If We provide written consent, You may transfer Your registration for this Event to a person (the “Transferee”), provided that the Transferee agrees to be bound by these terms and conditions in such manner as We require. If a transfer of a registration is made under this clause, no refund of registration fees will be payable.
18. Travel Insurance – First National will not provide Travel Insurance. It is strongly recommended you take out travel insurance, can be arranged through the nominated First National agent or 212F if requested and will be at your own expense. We will not take any responsibility for any delegate failing to adequately insure themselves.
19. Passport - International Travel – It is your responsibility to ensure that you have a valid passport which meets the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. Many countries require at least 6 months validity from the date of return and some countries require a machine-readable passport. We recommend that your passport be valid for at least 6 months post departure from the destination country and that your passport contains at least two unused and facing visa pages. If you are travelling on any other passport you may require a re-entry permit to re-enter Australia.
20. Visas – It is your responsibility to ensure you have the appropriate documentation including travel visas. Australian passport holders currently require visas when travelling to many countries. Other nationalities require a re-entry permit to Australia and may require additional visas. Please refer to our external visa advisory service provider, through the following link: https://cibtvisas.com.au/ We do not warrant the accuracy of such information and accept no liability for any loss or damage which you may suffer in reliance on it. If you wish, you can obtain visas through this external service and fees will apply.
21. Frequent Flyers – Please advise 212F of any frequent flyer membership details for inclusion in your booking, at the time of registration or prior to travel commencing. Please check your frequent flyer program for the specific terms of your membership. We cannot guarantee that the airline will credit you with points for your booking, as not all flights are eligible to accrue frequent flyer points. We recommend that you retain your boarding passes and ticket copies as proof of travel for points verification against your statement. Without these you may be unable to claim points. Should you wish to use your points to request a Flight Upgrade Award this must be done in accordance with your frequent flyer program. Not all flights are eligible, so please contact your airline membership program after receiving your confirmed ticket to arrange this service.
22. International Seating – First and Business passengers can generally be allocated seats at the time of booking. If travelling in Economy, 212F will make every effort to arrange your preferred seats, however assigned seat numbers can never be guaranteed and the airline ultimately reserves the right to amend seat allocations. Some airlines will permit advance seat selection on international flights for a fee, or if you are a member of their frequent flyer program. This allows you to choose the seat that suits you before you get to the airport.
23. Vaccinations and Health – You must ensure that you are aware of any health requirements for your travel and ensure that you carry all necessary vaccination documentation. Arrange to have all necessary inoculations well in advance of your departure date. Please check with your local doctor or specialist vaccination clinic. If you or people travelling with you take any medication make sure that you have enough for the duration of the trip. All medications and prescriptions should be carried with you on the aircraft and a certificate from your doctor verifying the need for the medication being carried is also advisable. Medication should have a professionally printed label identifying the medication or the manufacturer’s name or pharmaceutical label affixed. Some countries have restrictions on certain medications and it is advisable to check with the relevant consulate.
24. Governing law – These terms and conditions are made under and governed by the laws applicable in Victoria, Australia, and You accept the non-exclusive jurisdiction of the courts of that place.
25. Frustration of contract statutes not to apply - The parties agree that the sole rights and consequences of cancellation and variation are set out in this agreement. The Frustrated Contracts Act 1978 (NSW) and other legislation concerning frustration of contract, do not apply to this agreement.
26. Notices – Notices to You must be sent to the email address specified in the registration form You submit to Us. Notices to Us must be sent to Us at: hello@fnevents.com.au. A notice is deemed to have been received on the date of the email unless the same shall be outside the hours of 9am to 5pm on business days (being a day other than a Saturday or Sunday or a public holiday where the notice is served), in which case such notice will be deemed to have been served on the following business day.
